General terms and conditions of sale
Article 1: Preamble
These conditions of sale are concluded, on the one hand, by the company Start to Train whose registered office is located at rue des Bateliers 19 in 7330 Saint-Ghislain, Belgium, registered with the Crossroads Bank for Enterprises under number 0848342402, hereinafter referred to as "the seller" and, on the other hand, by any natural or legal person wishing to make a purchase via the seller's website, hereinafter referred to as "the buyer".
Article 2: Purpose
These conditions of sale define the contractual relations between the seller and the buyer as well as the conditions applicable to any purchase made on the seller's website, whether the buyer is a professional or a consumer.
The acquisition of a good or service through this site implies unreserved acceptance by the buyer of these conditions of sale. These conditions of sale will prevail over any other general or specific conditions not expressly agreed to by the seller. The seller reserves the right to modify its conditions of sale at any time, in which case, the applicable conditions will be those in force on the date of the order by the buyer.
Article 3: Characteristics of the goods and services offered
The products and services offered are those listed in the catalog published on the seller's website. Each product is accompanied by a description drawn up by the seller on the basis of information provided by the supplier.
The photographs in the catalogue are as faithful as possible but cannot guarantee perfect similarity with the product offered, particularly with regard to colours.
These products and services are offered within the limits of available stocks. If, despite its efforts, all or part of the items are unavailable, the seller will inform the buyer by e-mail as soon as possible and will give him the possibility to choose between waiting until a return to stock or canceling the order of the unavailable items free of charge. Available items will be delivered normally.
Article 4 : Rates
The prices of the products and services displayed on the site are indicated in euros including all taxes (note that the company is subject to the VAT exemption scheme for small businesses and does not charge VAT).
The seller reserves the right to modify its prices at any time. However, the prices applicable to the order are those in effect at the time of confirmation of the order. The prices indicated do not include transport and delivery costs.
These transport and delivery costs are communicated at the time of registration of the order and depend on the geographical area.
Article 5: Geographic areas
The online sale of goods and services presented on the seller's website is reserved for buyers who reside in Belgium, France, the Grand Duchy of Luxembourg or Switzerland and for deliveries required in these geographical areas.
Article 6 : Orders
The buyer, who wishes to purchase a product or service, must:
- complete the identification form on which he will indicate all the required contact details;
- complete the online order form, providing all the references of the products or services chosen;
- validate your order after having checked it;
- make the payment under the conditions provided;
- confirm your order and payment.
Confirmation of the order entails acceptance of these conditions of sale, recognition of having full knowledge of them and the waiver of relying on one's own conditions of purchase or other conditions.
All data provided and the recorded confirmation will be proof of the transaction. The confirmation will be worth signature and acceptance of the operations carried out. The seller will send by e-mail the confirmation of the recorded order.
Article 7: Right of withdrawal
In accordance with the law, the consumer has the right to notify the seller that he is withdrawing from his purchase, without penalty and without giving any reason, within 14 working days from the day after the day of delivery of the product or the conclusion of the service contract. This right of withdrawal does not belong to the professional buyer.
Within this period, the consumer must notify by e-mail his intention to renounce the delivered product and return, at his own expense and risk, said product to the premises of the company Start to Train located at rue de Favarcq 21 in 7970 Beloeil, Belgium.
Products must be returned in their original packaging, undamaged, accompanied by all their accessories, the user manual (if provided) and the original invoice or delivery note.
Returned products must not have been unpacked, unsealed, used in any way. Incomplete, damaged, damaged or soiled goods by the customer will not be taken back. The seller agrees to refund any payment, with the exception of shipping costs, within 30 days of acceptance of the return of the goods.
Article 8: Payment terms
Payment is made by PayPal or by Visa or Mastercard. The items ordered remain the exclusive property of the seller until full payment of the order by the buyer.
Article 9: Deliveries
Deliveries are made to the address indicated in the order form. This address can only be located in the agreed geographical area. The goods are transported at the seller's risk until the goods are delivered to the delivery address specified by the buyer. From that moment on, the buyer alone assumes the risks. Delivery times are given for information purposes only; if they exceed forty days from the order, the sales contract may be terminated and the buyer reimbursed.

With regard to consumers, the seller guarantees the products it sells and the services it provides in accordance with the law of September 1, 2004 relating to the protection of consumers in the event of the sale of consumer goods (articles 1649 bis to 1649 octies of the Civil Code).
In the event of non-conformity of a product sold noted within 2 months of delivery of the goods, the consumer must notify the seller as soon as possible in a precise manner by registered letter or e-mail. This guarantee only covers defects of conformity existing at the time of delivery of the goods. Defects or damage due to improper use, such as water damage, oxidation, falling or impact, negligence and wear, are not covered by the guarantee. Similarly, repairs carried out by technicians not approved by the supplier will result in the cancellation of the guarantee. The invoice or delivery note serves as a guarantee document and must be kept by the consumer and produced in original. If the product is used for non-private purposes, the limited guarantee conditions of the manufacturer/supplier apply.
Article 12 : Liability
Regarding the online sales process, the seller is only bound by an obligation of means. Its liability cannot be incurred for damage resulting from the use of the Internet network such as loss or theft of data, intrusion, viruses, service interruption, or other involuntary problems. The data included on the site is provided in good faith. Any links provided to the sites of manufacturers or partners are provided for information purposes only. The seller cannot be held responsible for information from these sites.
Article 13: Intellectual property
All elements of the seller's site are and remain the intellectual and exclusive property of the seller. No one is authorized to reproduce, exploit, rebroadcast, or use for any purpose whatsoever, even partially, elements of the site, whether software, visual or audio. Any simple or hypertext link is strictly prohibited without the prior and explicit written consent of the seller.
Article 14: Personal data
All personal data necessary for processing an order are kept by the seller or its employees and may be transmitted to companies with which the seller (or its suppliers) collaborate(s), when such communication is necessary for processing the order.
Furthermore, the user also authorizes the seller to use this data to establish statistics in order to improve its site, the goods and the service it offers. This information can be used to allow the dissemination, by any communication channel, of information relating to the seller's commercial activities to its customers. Finally, the seller keeps the personal data of its customers in order to facilitate any subsequent order. For the rest, the seller undertakes not to disclose the information it has to a company or other third-party company. The data kept by the seller can be requested and corrected at any time upon simple request via the contact form available on the site or by telephone.
Article 15: Proof
The parties accept, within the framework of their relations, electronic means of proof (for example: e-mail, computer backups, etc.).
Article 16: Dispute Resolution
These online sales conditions are subject to Belgian law. In the event of a dispute, the courts of the seller's registered office shall have jurisdiction, unless there are binding public policy provisions.
